1) Agreement to these Terms
By using our website, requesting a quote, placing an order, or renting any item from us, you agree to these Terms & Conditions (“Terms”). If you do not agree, do not use the site or place an order.
These Terms apply to all rentals, deliveries, pickups, and related services. Some orders may also include a separate invoice, quote, or rental agreement; if there’s a conflict, the order-specific agreement controls for that order.
2) Online bookings (Booqable)
Our online booking and product catalog are powered by Booqable. When you reserve items through our site, your checkout experience may be embedded on our site or routed through Booqable. Booqable and its service providers may process order details and payments to complete your reservation.
3) Quotes, reservations, and availability
- Quotes are not reservations. Items are not guaranteed until you receive an order confirmation and any required payment is received.
- Inventory shown online reflects current availability, but availability can change quickly, especially for peak weekends.
- We may substitute an item only with your approval, unless the substitute is equal or better and fulfills the same function (for example: a same-size table in the same color).
4) Pricing, fees, taxes, and minimums
- Prices are shown per rental period (example: 24-hour rental) unless stated otherwise.
- Delivery/setup fees, pickup fees, fuel/travel fees, service fees, and taxes may apply.
- Some orders require a minimum subtotal for delivery. Minimums and service-area fees may apply based on distance and delivery window.
5) Payments, deposits, and authorization holds
- Payment terms are shown at checkout or on your invoice/quote.
- We may require a deposit or card authorization hold to reserve inventory, especially for larger orders.
- You authorize us (and our payment processors) to charge the payment method you provide for amounts due under these Terms, including approved add-ons, damage, loss, late returns, or unpaid fees.
6) Cancellations, changes, and rescheduling
Your cancellation and change terms depend on what you select at checkout or sign on your invoice.
- Cancellations 7+ days before delivery/pickup: refund minus a processing fee of 5%.
- Cancellations 3–6 days before: 50% of rental charges are non-refundable.
- Cancellations 0–2 days before: rental charges are non-refundable. Delivery/setup fees may be non-refundable once routing and scheduling begins.
- Reschedules: one reschedule is allowed up to 7 days before, based on availability. Price differences may apply. Reschedules convert payments to credit (not refund), valid for 12 months.
Custom orders, special-order items, and same-day orders may be non-refundable.
7) Delivery, setup, and pickup
Delivery windows are estimates. You agree to provide:
- Accurate address, contact number, and delivery instructions (gate codes, parking notes, loading access).
- A safe, clear path for delivery (free of obstacles, pets, debris).
- A responsible adult (18+) on-site to accept delivery unless you authorize contactless drop-off in writing.
Setup rules:
- Standard delivery typically includes placement in a ground-level accessible area. Stairs, elevators, long carries, tight access, and venue restrictions may add fees.
- We do not move items after they are placed unless scheduled and paid as an add-on.
Pickup rules:
- Items must be ready and accessible at the scheduled pickup time.
- If items are not ready or access is blocked, additional trip/late fees may apply.
8) Customer pickup orders
If you choose customer pickup:
- You are responsible for loading, securing, transporting, and unloading items safely.
- You must use an appropriate vehicle and tie-downs as needed.
- Damage during customer transport is your responsibility.
9) Use, care, and restrictions
You agree to:
- Use rental items safely and only for their intended purpose.
- Keep items away from open flame, extreme heat, sprinklers, smoke machines/fog fluid, sand/dirt exposure, paint, confetti cannons, and other hazards unless we approve in writing.
- Keep items dry and protected. Rain, wind, and moisture can damage rental equipment.
- Do not tape, nail, staple, glue, paint, or attach décor directly to rental items unless we approve and provide the correct materials.
10) Cleaning
Normal use is expected. Excessive mess (wax, food grease, gum, stains, adhesive residue, confetti/glitter, sand, mud, liquids inside equipment) may result in cleaning fees.
11) Damage, loss, and theft
You are responsible for rented items from the time they are delivered (or picked up) until the time they are returned and checked in by us.
If items are damaged, missing, or stolen, you agree to pay:
- Repair costs or full replacement cost (new-for-old), plus
- Any applicable labor, cleaning, parts, or transport costs.
Do not attempt repairs yourself unless we approve.
12) Late returns and extended rentals
Late returns may be charged at an additional daily rate and may impact other customers’ reservations. If you need extra time, contact us as soon as possible to request an extension (subject to availability).
13) Digital photo booth / selfie station
If you rent a Digital Photo Booth / Selfie Station:
- You are responsible for providing a safe, dry, stable location and power access.
- You agree to supervise guests and prevent misuse, tampering, tipping, or liquid exposure.
- Digital sharing features depend on venue connectivity and device settings; we do not guarantee network speed or guest device compatibility.
- You represent that you have permission to capture and share images of attendees. You are responsible for guest notices and any required consents.
14) Safety and assumption of risk
Rental equipment can cause injury if misused. You accept all risks related to use and presence of rental items at your event and agree to supervise children and guests.
15) Limitation of liability
To the fullest extent permitted by law:
- We are not liable for indirect, incidental, special, or consequential damages (lost profits, lost event costs, reputational harm).
- Our total liability for any claim is limited to the amount you paid to us for the affected rental order.
16) Indemnification
You agree to defend, indemnify, and hold Desert Party Supplies harmless from claims, damages, losses, and expenses (including attorney fees) arising from your use, possession, transport, or operation of rental items, or from your violation of these Terms.
17) Force majeure (events outside our control)
We are not responsible for delays or failure to perform due to events outside our reasonable control (severe weather, road closures, power outages, venue shutdowns, strikes, supply interruptions, or government actions). In these cases, we will work with you on rescheduling or credits where feasible.
18) Website content and intellectual property
All website content, photos, logos, and text are owned by us or our licensors and may not be copied or used without permission.
19) Disputes and governing law
These Terms are governed by the laws of the State of Nevada. Venue for disputes will be Clark County, Nevada, unless required otherwise by law.
20) Changes to these Terms
We may update these Terms from time to time. The latest version will be posted on this page with an updated effective date.
